Terms and Conditions of Charter & Hire

Liberty Transport (trading as Liberty Bus Hire) provides safe, compliant and reliable transport services throughout Sydney and New South Wales. These Terms and Conditions outline the rights and obligations of the Hirer and Liberty Transport. By confirming a booking, paying a deposit or using our services, you accept and agree to be bound by these Terms and Conditions.

Liberty Transport operates in accordance with all Transport for NSW requirements, the Passenger Transport Act, and applicable road, safety and workplace regulations. The most current version of these Terms and Conditions is published on our website and may be updated without prior notice.


1. Passenger Conduct

1.1 Drivers are responsible for the safe operation of the vehicle and may refuse entry or remove passengers engaging in unlawful, dangerous or disruptive behaviour.
1.2 The Hirer is responsible for passenger behaviour and is liable for damage caused by passengers.
1.3 Costs associated with damage, repairs, cleaning or disruption may be charged to the Hirer.
1.4 Smoking, vaping and e-cigarettes are strictly prohibited. Passengers smoking outside must remain a minimum of 4 metres from the vehicle.
1.5 Drivers may refuse transport to intoxicated, aggressive or unsafe passengers.
1.6 Charters may be terminated immediately due to unsafe behaviour. No refund or compensation applies.
1.7 Passengers must not interfere with vehicle equipment or fittings.
1.8 The Hirer should inspect the vehicle prior to departure and advise the driver of any concerns.


2. Food and Beverage

2.1 No food or drink may be consumed onboard except for bottled water, in line with NSW regulations.
2.2 Passengers must remain seated while the vehicle is moving, and limbs must not be extended outside the vehicle.
2.3 Passengers must remove all rubbish. A cleaning fee of $88 (incl. GST) applies if unreasonable mess is left behind.
2.4 The Hirer is liable for additional cleaning, damage, fines or penalties.


3. Alcohol

3.1 Consumption of alcohol is prohibited onboard all vehicles.
3.2 Liberty Transport does not provide party bus services.
3.3 Alcohol may not be brought onboard unless expressly approved in writing. Approved unopened alcohol must be stored by the driver.
3.4 Alcohol consumption onboard results in immediate termination of service with no refund, plus a $300 penalty.
3.5 If alcohol is covertly brought and consumed:
- $300 penalty, plus
- $110 cleaning fee for floor spills, or
- $330 cleaning fee for seat spills.


4. Additional Charges

4.1 Changes to itinerary affecting time or distance incur additional charges. Tolls, parking fees and venue entry fees are charged separately.
4.2 Unexpected costs such as waiting time, fines or additional cleaning are the Hirer’s responsibility.
4.3 Hirers must select safe and legal pickup locations. Fines arising from unsafe or illegal stops may be passed on.
4.4 A 15-minute grace period applies. Waiting time is then charged from the scheduled pickup time.
4.5 Waiting time rates:
- Minibuses: $30 per 15 minutes
- Coaches: $50 per 15 minutes
4.6 Liberty Transport may charge the Hirer’s credit card or apply deposits to outstanding costs.
4.7 The Hirer is responsible for fines resulting from passenger misconduct.


5. Cancellations, Charges and Refunds

5.1 If the vehicle has departed the depot and the service is not used, full charges apply.
5.2 If passengers fail to present within 45 minutes of pickup time, the charter is terminated and full charges apply.
5.3 Failure to pay when required is treated as a non-cancelled service.
5.4 Cancellations must be made in writing. Non-payment does not cancel a booking.
5.5 Cancellation fees:
- Within 48 hours: 100%
- 3 days prior: 70%
- 4 days prior: 50%
- 5 days prior: 35%
- 6 days prior: 20%
- 7 days prior: 10% or forfeited deposit (whichever is higher)
5.6 If Liberty Transport cannot operate due to mechanical failure, only the unused portion of the fare is refunded. No consequential loss is covered.
5.7 The Hirer must pay supplier costs associated with cancellations.


6. Tentative Bookings

6.1 Tentative bookings expire after three days.
6.2 A 20% non-refundable deposit is required to confirm a tentative booking.


7. Quotes

7.1 Quotes are valid for 14 days.
7.2 Amendments to charter details may alter the quoted price.


8. Payments

8.1 Bookings more than 7 days out require a 20% non-refundable deposit unless agreed otherwise.
8.2 Full payment is due 7 days prior to service unless agreed in writing.
8.3 Bookings within 7 days require full upfront payment.
8.4 Failure to pay by the due date cancels the booking and full charges apply.
8.5 Late payments may incur 10% compound interest per calendar month.
8.6 Debt recovery costs, including legal fees, are payable by the Hirer.
8.7 The Hirer is personally liable for all payments.
8.8 Accepted payments: Visa, Mastercard, AMEX, Diners, EFT (no cheques or cash on the day).

8.1 Additional Payments

8.1.1 A security bond may be required.
8.1.2 The Hirer authorises Liberty Transport to debit charges for waiting time, damage, fines, tolls, entry fees or unpaid charges.
8.1.3 Legal recovery costs for unpaid fees are payable by the Hirer.


9. Breakdowns and Delays

9.1 Journey times are estimates and delays may occur due to factors beyond control.
9.2 Delays do not provide grounds for refunds or cancellation.
9.3 Drivers select routes based on safety and efficiency.


10. Driver Hours

10.1 Drivers must comply with NSW fatigue laws: maximum 12 hours’ work in 24 hours, including required rest periods.


11. Passenger Property and Lost Property

11.1 Drivers determine whether luggage can be carried safely.
11.2 Luggage is transported at the passenger’s own risk; Liberty Transport accepts no liability.
11.3 Lost property is held for three weeks before disposal.


12. Equipment

12.1 Vehicles are inspected prior to service; replacement vehicles may differ in type.
12.2 DVD equipment cannot be guaranteed and depends on vehicle allocation.
12.3 Public showing of copyrighted material requires appropriate licensing.
12.4 Licences must be provided in writing at least 48 hours prior.


13. General Terms

13.1 Liberty Transport may subcontract services.
13.2 Passengers must follow driver instructions in emergencies.
13.3 Drivers may adjust itineraries for safety or legal requirements.
13.4 Changes requested during a charter are subject to driver discretion.
13.5 Confirmation of booking or payment indicates acceptance of all terms.


14. Overnight and Extended Charters

14.1 A private hotel room (minimum 3-star) must be provided per driver on overnight charters.
14.2 Liberty Transport can arrange accommodation and invoice accordingly.
14.3 Itineraries must be provided:

  • Draft: at least 1 week prior

  • Final: 2 days prior
    14.4 Drivers may stay at alternate accommodation.
    14.5 A $60 per day meal allowance applies.


15. Complaints

15.1 Complaints must be submitted in writing via email.
15.2 All complaints are recorded in accordance with NSW regulations.


16. Notices

16.1 No signage or decorations may be attached to vehicles without written approval.
16.2 Costs associated with signage installation or removal are the Hirer’s responsibility.


17. Governing Law

These Terms and Conditions are governed by the laws of New South Wales, Australia.


18. Force Majeure

Liberty Transport is not liable for delays or unfulfilled services caused by events outside reasonable control, including weather, accidents, industrial action or government restrictions.


19. Limitation of Liability

19.1 Liberty Transport is not liable for indirect, incidental or consequential loss.
19.2 Liability is limited to the charter fee for the affected day.


20. Price Changes

20.1 Prices may vary due to changes in fuel, legislation, market conditions or updates to the final itinerary.


21. Prohibited Items

The following items are not permitted onboard:

  • Decorations

  • Alcohol

  • Smoking, vaping and e-cigarettes

  • Glass containers

  • Golf shoes or spiked footwear

  • Fuel containers

  • Generators

  • Illegal substances


22. Entire Agreement

These Terms and Conditions constitute the entire agreement between the parties and override any prior agreements or representations.
